Erin M. Hickey
Hickey is a seventh-year associate with Fish & Richardson P.C. A member of the firm's Trademark and Copyright Group, Erin specializes in all aspects of trademark law, including selecting, prosecuting, licensing, and enforcing trademarks, as well as defending clients against claims of trademark infringement or unfair competition. She regularly litigates trademark matters before federal district courts as well as the Trademark Trial and Appeal Board of the United States Patent and Trademark Office. She often assists clients with advertising review, including false advertising, comparative advertising, and right of publicity issues and has represented clients before the National Advertising Division of the Council of Better Business Bureaus, Inc. She is also skilled in counseling clients with respect to prosecuting and enforcing non-traditional trademarks, such as color, motion, and three-dimensional trademarks.
In addition to her regular practice, Erin also has an active pro bono practice with the firm. In particular, Hickey has developed an expertise in litigating capital matters. Currently, she is serving as lead counsel for the firm in representing a death-row inmate in his state post-conviction relief proceeding pending in the Superior Court of Maricopa County, Arizona. In 2009, she won a re-sentencing hearing for her client, a death row inmate in Virginia. The decision by the Supreme Court of Virginia is precedential.
