Thomas Jefferson Professor Speaks to
National Contract Management Association
“From Courtney Love to Dave Chappelle and Howard Stern”
SAN DIEGO—Thomas Jefferson School of Law Professor Kevin Greene will be the luncheon speaker at The San Diego Chapter of the National Contract Management Association (NCMA) conference here on December 6th.
Professor Kevin “K.J.” Greene is a well-known expert in entertainment and contract law. His clients have included film director Spike Lee and the rap group Public Enemy.
His presentation is entitled “Contract Making, Contract Breaking and Damages Hollywood Style: From Courtney Love to Dave Chappelle and Howard Stern.”
The luncheon will be held at the Hanalei Hotel in Mission Valley, 2270 Hotel Circle North, San Diego, from 11:30 a.m. to 1:00 p.m.
Among the questions he will discuss:
• What can the high-stakes, high-profile world of entertainment contract
litigation teach about general contract principles and perhaps, contract
law reform?
• Does unconscionability doctrine have any appropriate application outside
the context of big business versus consumers? This issue arose in rock star
Courtney Love’s battle to escape a record contract.
• Does the duty of good faith and fair dealing substitute for good contract
drafting? This issue surfaced in CBS Radio’s contractual fight against shock jock Howard Stern.
• What damages should courts award where the underlying contract involves
highly speculative or uncertain ventures? This was at issue in a breach of
contract suit against comic Dave Chappelle by his purported former manager.
