This course examines civil and criminal trial practice for the student whose plans for the future include courtroom litigation. The course will provide advanced training in each phase of trial preparation including motions in limine, voir dire, opening statements and closing arguments, direct and cross examination, witness impeachment, and rehabilitation
American Indian Law
This course will survey federal statutory, treaty, and case law relating to Native Americans, including such issues as Native sovereignty and self-determination, criminal and civil jurisdictional conflicts, treaty rights, native economic development and gambling, the Indian Child Welfare Act, and Native religious rights. The course will use a historical perspective to illuminate current issues and controversies.

Bioethics
Bioethics explores the ethical problems raised by developments in the life sciences (medicine, genetics, biology). This seminar will examine a sampling of these ethical issues as they have made their way through the legal system. Course topics will include the evolution and current contours of “the right to die,” the living will movement, euthanasia and physician-assisted suicide, artificial reproductive techniques and their regulation, genetic screening, and the allocation of medical resources in the managed care era.
Business Drafting: Course Reserves
Civil Motion Practice
A practical course designed to acquaint students with typical law and motion matters encountered by the beginning civil practitioner in California. Students will be required to prepare and argue three motions. Classroom discussion will emphasize writing techniques as well as procedural and substantive details such as proper notice, service and time limits. Tactical decisions also will be addressed.

This course considers legal problems with multistate aspects: jurisdiction, conflict of laws and choice of law; recognition and enforcement of judgments.
Copyright
This course focuses on the legal issues arising from the creation, ownership, production, marketing, and distribution of literary, pictorial, graphic, sculptural, musical, digital, and related works. This will include examination of copyrightable subject matter, the idea/expression dichotomy, compilations and derivative works, duration and renewal, fair use and the impact of past laws, related state laws, and international copyright law.
Critical Race Theory
Cyber Crimes
Cyber crimes will examine crimes accomplished through the use of the Internet. These crimes include copyright violations, hacking, computer viruses and Internet pornography. The course also will examine some procedural topics in criminal cases, including jurisdictional questions and the constitutionality of police searches conducted over the Internet. The course will cover the elements of various Internet crimes and consider basic questions raised by prosecution of Internet activities. For example, will criminal prosecutions destroy the anonymity and the freedom of the Internet. In addition, the course will discuss the difficulties of prosecuting Internet crimes, where the perpetrators may be located outside of the United States, and may move their operations on a regular basis.

This course explores the philosophical and theorectical underpinnings of the law. All of the schools of jurisprudential thought are discussed. The differing approaches are related to legal and case analysis. This course is graded non-anonymously and may satisfy the upper legal writing requirement.

Legal Writing II
Legal Writing I introduced you to the reasoning, research, and writing methods that an attorney uses to make decisions about concrete legal problems. Legal Writing II builds on those methods in the context of persuasive written and oral advocacy. Legal Writing II is designed to teach you methods for researching a client's legal problem, creating and testing arguments, and persuasively communicating those arguments to judges, both in writing and in oral argument.

The course focuses on First Amendment law relating to government regulation of the media and on emerging state and federal law issues arising from the newsgathering process.

Negotiation Theory and Skills
This course involves a practical study of the theory and skills used by lawyers in negotiations. The course will use readings, practical hands-on exercises, written planning documents, and written self critiques as the basis for developing each student’s understanding of the negotiation process and his or her individual negotiating style. We will explore both competitive and cooperative approaches to negotiation, as well as ethical, strategic and tactical issues.
