Sexuality, Gender & the Law,

Sexuality, Gender and the Law explores the legal issues related to sex, gender and sexual orientation. The course focuses on the role that our laws play in creating and reinforcing sexuality and gender norms. The course examines a number of constitutional issues, with a focus on equal protection doctrine as it applies to issues of gender and sexual orientation, the role of the state in regulating sexual conduct under the due process clause, and the first amendment and sex-related speech and conduct. Specific topics may include: sex and sexual orientation discrimination; reproductive rights including contraception, abortion and surrogacy; sexual acts including incest, polygamy, rape and prostitution; sex related speech including sex education and pornography, and family issues including marriage, custody and adoption. This course is graded non-anonymously.

Prerequisite: Constitutional Law I
