Professor Templin speaks on IP Infringement in China

TJSL Professor Ben Templin recently returned from Tokyo, where he gave a lecture at Waseda University titled “Intellectual Property Infringement in China: Recent Case Studies.” Professor Templin discussed recent statistics on piracy in China and the international intellectual property legal regimes that are exerting pressure on Chinese officials to improve enforcement. The discussion looked at three recent case studies and the effectiveness of both legal and non-legal strategies in deterring and resolving issues involving intellectual property rights. The three case studies included: Michael’s Jordan’s trademark infringement lawsuit against Qiaodan Sports, the dispute between Apple Computer and Proview over ownership of the iPad trademark in China, and litigation involving theft of trade secrets by Chinese wind turbine manufacturer, Sinovel. In each case, Professor Templin, who teaches IP, contracts and administrative law, explored whether non-legal strategies would produce better outcomes than criminal prosecution or civil litigation.
